The City's Responses to 5 FOIA requests
The first FOIA is for all costs by incurred by the City of Lincoln Park after the exhaustive lawsuit brought against City of LP and LP DDA by JJM Construction. This case was settled secretely and we the taxpayers have a right to know how much this suit cost us to fight and then ultimately to cut our losses and settle with this company. This FOIA is for all cell phone reimbursement for non city cellular phones. The city has asked for a 10 day extension. This makes me question exactly what documentation was used in the slanted articles. The FOIA requested is the first page, the following pages are the responses from the City. This FOIA is for all Early Retirement Incentive costs, benefits, account statements of the pension funds, actual number of employees that took the ERI by dept and cost savings or increase as a result also the actuary reports AND the 50++ page document given to Ed Zelenak and News Herald. The city has asked for a 10 day extension which is interesting because Mayor Pro Tem Kandes and Ed Zelenak both said in two meetings that this information would be available the next business day. What they really meant was that they have no REAL numbers and want to try and snow us a little while longer. This makes me question exactly what documentation was used in the slanted articles. This FOIA is for information handed out or discussed in closed session regarding the Kaminski versus City of Lincoln Park and Mayor Steve Brown Individually. Now remember that Ed Zelenak and Steve Duchane accused us of trying to force them to hide information which they both said was totally available and that our OMA complaint did not have merit. They both applauded the opinion of the Assistant Prosecutor and called his opinion "gospel". His opinion (and please refer to that document that is in the forums) states that our Mayor and Council can discuss and dissiminate any and all information & documents that were discussed or distributed in a closed session to the public ... all EXCEPT for the actual minutes of the closed session. So now I have to go to the podium and ask them WHY they are refusing to release this information afterall they beleive they were in the right on our OMA complaint and embraced the PA's opinion without question. If they beleive the PA's opinion is accurate then they MUST release this information OR is it that they know our OMA was a very valid complaint and they know they were wrong???? This FOIA is for copies of all city paid cell phone contracts in effect prior to February 2005. The only documents they granted were Higgins and Brady's. I will have to call and fax a letter to advise them it is missing the rest of the contracts. The FOIA requested is the first page, the following pages are the responses from the City. FOIA partially given for City paid cell phone contracts. Sure sounds like that the City Leaders only want to release what they want us to have and nothing more. |

So all requested information was put on a 10 day extension? The news herald seemed to have info post stat. According to Mark Kandes, ERI documents are all at Donna Breedings Desk for review. That takes 10 days to cross the street? Attorney Client Privilage? Makes sence to me BUT AND I STRESS BUT I figured that participating in open collective bargaining under the "Good Faith" they are supposed to do, that spilling information related to the closed session discussions, while admittedly both unethical and illegal by our mayor, council and even city attny to some extent, then recanted to say was completely ok to do...would have violated the OMA, Ethics Ordinances, our city charter, as well as some labor laws...but apparently, I guess they can claim "confidentiality" when they feel like it, and get a Judge to claim all info is up for public consumption when they feel like it too. Anyone see a real hypocritical set of circumstances here?

It appears that the City of Lincoln Park Government is a government of themselves, by themselves and for themselves. What a country, eh? Makes me sick!

Why was not an outside prosecutor from another county reviewing this complaint? Mayor Brown works for Wayne County. In any other county this would have been turned over to another county. the press blew this one. the complaint was doomed from the start. |
