A federal judge approved a $12.7-million settlement Tuesday to reimburse more than 10,000 mostly Downriver residents for basement flooding that resulted from a September 2000 rainstorm.


U.S. District Judge John Feikens signed an order settling the dispute during an hour-long court hearing Tuesday. He said he would enter the order when Wayne County's eight communities finish depositing money into a bank account to pay for the settlement.


Wayne County will pay $5.5 million; Allen Park, $3.35 million; Dearborn Heights, $325,000; Ecorse, $195,000; Inkster, $100,000; Lincoln Park, $150,000; Riverview, $5,000; Southgate, $2.625 million, and Taylor, $500,000.


Residents sued the county and the communities after sewers backed up into their basements from the heavy rainfall. Lawyers for property owners in the class action -- Steven Liddle and Peter Macuga -- have requested $4.1 million, the standard one-third fee for handling the lawsuit. They also have requested $427,366 for costs associated with the lawsuit over the past 4 1/2 years.


Feikens said Tuesday that he wouldn't approve $71,500, which the lawyers paid a lobbyist to persuade the Legislature to adopt a law to ensure homeowners would be reimbursed for damages. Feikens said that cost shouldn't come out of the settlement.


"After a long drawn-out battle that took to the Michigan Supreme Court, the Legislature and the U.S. 6th Circuit Court of Appeals, we finally are able to provide relief for the homeowners," Liddle said afterward. The U.S. appeals court is in Cincinnati.


He said homeowners have until June 24 to file a claim. He said homeowners should receive payments beginning in late summer.


Liddle told the judge that 400 of the 10,548 homeowners who have said they have a claim have already filed one. Homeowners who haven't, or who want more information about the settlement, should call the law firm at 313-392-0015.

Spring of 2004 made 2000 look like a drought. How much will the city be paying out to those people?

Mr Sochocki was long gone from the scene. If the courts felt the city was at fault for 2000, they will crucify them for 2004.
