Why is the Media Policy that is adopted not being followed?

Why is our City Attorney being a smart alec about this? This is NOTHING to get smarty about. Long time LP businesses are in trouble and our city officials are being smarty butts?

I hope someone gets sanctioned for not following the media policy -- this is why we need one.

Felumena Wilson watched two customers pay their bill and depart the Park Restaunte early afternoon a couple weeks ago.

It was the end of what should have been the noon rush, but the diner at the corner of Fort and Arlington in Lincoln Park was empty except for a pair of cooks and Wilson, the waitress.

"Business is absolutely terrible," said Wilson. "Waitresses aren't making any money."

For Park Restaurant co-owner Eleas Moraitis, 41, the outlook is worse. He's afraid his family business will fold if this dead time goes on.

The slump began in August, when a developer bulldozed the lot where customers have parked their cars since the restaurant was opened in 1976 by Moraitis' parents, John and Tula Moraitis.

Last month, Southfield-based developer Lincoln Commons LLC ripped up the parking lot as part of its plan to build 39 condominiums on a side street behind the restaurant.

"It's going to be a complete catastrophe," said Eleas Moraitis.

Moraitis' father, John, 71, has sued the city, demanding compensation for lost business, and an injunction to halt work at the parking lot.

Last week, Lincoln Commons counter-sued the city's Downtown Development Authority, demanding that the authority cover the developer's legal expenses from the Moraitis lawsuit. The case is to be heard by a judge on Oct. 14.

Says City Manager Steve Duchane, "It's difficult and about very little -- what seems to be a very straightforward situation."

An attorney for Lincoln Commons did not return calls seeking comment.

City Attorney Ed Zelenak said the city has tried over several years to convert this part of downtown Lincoln Park into a mixed-use area of homes and businesses. An earlier developer of the property had sued the city and won a settlement after the city reneged on a development plan, said Zelenak.

While the developer has been slow to finish, once the condos are completed, the developer has agreed that the parking lot will be restored with 72 spaces for the Park Restaurant and other nearby businesses and a church to share, said Zelenak.

The restaurant will see new customers from the condos, said Zelenak.

But Eleas Moraitis said he's upset that the city sold the parking lot three years ago without public notice. The DDA sold the land to Wyandotte businessman Joseph Daly for a dollar, and Daly sold it to Lincoln Commons for $100,000, said Moraitis.

Daly didn't return calls seeking comment.

Eleas Moraitis said that if Daly wasn't going to build condos, the city should have taken the land back. If the city had offered it to him, he would have tried to buy the land, he said.

Duchane said there were public hearings on how land should be used.

John Moraitis has sued the city, the Lincoln Park Downtown Development Authority and Lincoln Commons. He's asked a Wayne County Circuit judge to order compensation for his losses and to stop condo construction. His lawsuit claims his restaurant's longtime use of the parking lot amounts to a form of ownership.

John Moraitis' assertion that his business has a claim to the land because it had always used it as a parking lot is a novel contention, Zelenak said.

"It would make a good bar exam question," said Zelenak.

John and Eleas Moraitis aren't the only ones upset about the loss of parking.

Jerry Grubbs, pastor of the Faith Tabernacle Church of God just north of the condo site, says his church lost nearly all its parking because of the condo construction. The church needs as many as 150 parking spaces on Sunday mornings, yet the condo construction has cut him back to a handful of spaces on the street.

Even worse, Grubbs said, the contractor has broken up the sidewalk around the church, making it difficult for worshipers to get to the building.

It's especially hard on handicapped and older people who are forced to walk across grass to get to the main door of the church, said Grubbs.

The city is hoping that Lincoln Park-based American Indian Services, Inc. will run a proposed Winding Waters Indian Art School in three buildings in the same block with the Park Restaurant. But Fay Givens, director of the organization, says she won't move there unless she is assured there will be ample parking.

Givens has written to Gov. Jennifer Granholm proposing that the Michigan Department of Transportation install parking spaces on what is now the grassy median of Fort Street.

At MDOT, spokesman Rob Morosi said: "Obviously, if the governor passes this down and asks us to look at it, we'll be more than willing to take a look at it.

"You're looking at a boulevard separated by a median with the intention of moving large volumes of traffic. We would have to study that at length to determine if we will compromise the flow of traffic, but most importantly, the safety of motoring traffic and pedestrians," he said.

Givens thinks her proposal would solve the Park Restaurant's problems, too.

But Eleas Moraitis said an MDOT study would take too long.

"By that time, I'll be out of business," said Moraitis.

What aspect of the policy are you saying wasn't followed?

This specifcially but overall the entire issue has been handled poorly and instead of our City Officials at least pretending to be supportive of the loss of income these businesses are experiencing, we have rogue officials being short and downright rude when pressed about this project.

Case in point is Mayor Brown's rudeness to the people at the podium about the parking.

Case in point is the the nonchalant attitude (like in the article) towards long term businesses.

Whether or not there were one or many meetings...this does not negate the fact that long term businesses are in trouble as a direct result of this project.

The way this is being handled in the past and currently is not showing current or potential new businesses that Lincoln Park cares and supports their businesses.

If our city officials (some of them) can be so callus with business owners that have been here for years..... what would potential new business owners think?

I was so delited to see Felumena Wilson mentioned in the article. She and her husband are such nice young people. I was good friends with her in-laws though I have not seen them in almost 30 years.

Her father in law was a washer repairman at Wards. When they eliminated the washer repair people they made him a tv repairman. He told them he didn't know the first thing about tv's. Wards told him not to worry, he could "learn on the job" They gave him a crash course. He would then go to people's homes and look at the television to be repaired. If it wasn't something simple he could repair, he would have to bring it back to the shop.

Do they even have tv repairmen coming to the house anymore? Most televisions are so inexpensive I doubt it is worth getting most repaired. And most people no longer have the heavy console tv's, so unless they have a Big Screen television it is easier to bring the television to the shop.

I will have to stop by The Park some time when Felumena is on duty and see how her in-laws are doing.

I, too, am worried about how our city is perceived as working with businesses (and, in fact, the residents). Mark has stated over and over again that we are not anti-business/resident. But, when articles like this show up in the press (whether true or embelished), those reading the article may choose to move on to another city.

This is eventually dangerous for our city's prosperity!

(Deep in the back of my mind, I keep wonderinf: What happens if these condos do not sell? Or if they sell, and the owners change their minds after a short period of time--and the condos remain empty for a time. It will be too late then to realize that we made the wrong move. We'll just have ended up with even more empty/vacant buildings that no one wants.)

I still can't get over the fact that the DDA sold this property for $1.00 to Joseph Daly. He turned around and sold it for $100,000! No wonder he can't be reached for comment.

Someone from the DDA should answer to the citizens for this. This article claims that it was sold without public notice. Is this true?

To the best of my knowledge, Mr. Tamsen was and is the attorney for the DDA. Has anyone questioned Mr. Tamsen on this?

Robin, or anyone, who is accountable for this? Can anyone fill me in on how this transaction happened?

Let's be fair to the DDA. Selling the property for $1.00 was not a bad move. They were trying to create development in this long abandoned area.

They got slickered. Plain and simple.

If anyone is to blame it would be the lawyer for the DDA, he should have known better. For the most part the DDA are local businessmen who were trying to do what was best for the city.

Their lawyer let them down. The lawyer should have placed a clause which restricted the developer from re-selling the land. There should have been a stipulation that required the developer to develop the land for a specific purpose. If the failed to do so, the land would return to the DDA.

Do not blame the Businessmen for trying to generate development. Blame their lawyer.

I know that Tamsen became the DDA attorney when Sochocki was Mayor and that the parking lot was also sold when Sochocki was mayor. Prior to that the DDA did not have an attorney. I remember well what transpired with the previous developer, going to bid for condo developers etc. but don't recall Tamsen being part of it. I could be wrong though.

Yep, but it isn't cost effective for the homeowner. Fred used to do VCR/TV repairs prior to computers. Most of the time it is cheaper to replace the tv than fix it. Fred's grandfather used to have a Lincoln Park tv repair business called Tom's TV which I think would of been the mid-1950's. It was on Southfield and Applewood. I think it is a smoke shop now.

There had to be an attorney involved in the process. When was the property sold for $1.00? I remember reading Disanto was questioning this issue recently.

I'm sure that the DDA utilized the City Attorney prior to having their own attorney. However, Bill Hatley is an attorney and he was running the DDA back then. As I recall the idea of the DDA having their own attorney was Mayor Sochocki's idea.

Nice to hear at least one person was not asleep at the switch.

How could the DDA have entered any type of transaction without an attorney? If they sold this parcel for $1.00 without an attorney, then shame on them.

If the City Attorney was acting as the DDA Attorney, then shame on him. He should have ensured the property could not be resold at a substantial profit.

The Parks customers are in the other 2 restaurants .they have left the Park years ago . The first one opened over 4 years ago and now the Mexican restaurant is open has made enough to make improvements to the outside already. He is blaming the condo's for his lack of business what a joke. No one can force someone to eat at his place if they get better prices and food down the street.

People stopped going in there for what he did to his neighbors with the last developer. He wants the city to pay for his bad business decisions . He has competition and can't deal with it.
There is no place for DPS workers to park their equipment and go in for lunch. The lot across Arlington is almost always half full with 10-15 cars from ElPaso the restaurant in the middle of the block has 8-12 all the time even more on Sunday .I counted 55 cars on a Sunday evening and only !bar and the other restaurant were open.
