What is status of 1583 College property, Councilwoman Brady asks City Attorney
Councilwoman Brady wanted to know the status of this City of Lincoln Park owned property of 1573 College. According to records, Councilwoman Brady states that no property taxes has been remitted to the City of Lincoln Park. Apparantly the mortgage company collected the property taxes but never paid them. Homeowner's is suing the Mortgage Company and until this is resolved. But within the remedies is full payment of the last 5 years of property taxes due to Lincoln Park. According to Ed Zelenak, there are two properties with the similar problems - one with Countrywide and one with Abn-Ambro. Abn Ambro and Countrywide

From March 17, 2003 RESOLUTION 03-132 Transfer Property to EDC
By Council President Kandes, supported by Councilwoman Mondon. From June 28, 2004RESOLVED, that the Mayor and City Clerk are authorized to execute Quit Claim Deeds to the Economic Development Corporation for the following properties: 872 Goddard 1583 College 1778 Lafayette subject to the E.D.C. rehabilitating of said structures and selling same as single-family homes. EDC to reimburse the City relating to acquisition and maintenance costs to the City. Motion unanimously carried.
RESOLUTION 04-347 Relinquish Property/1583 College By Councilman Murphy, supported by Councilwoman Brady RESOLVED, that the City of Lincoln Park accepts the sum of $10,111.86 tendered by ABNAMRO MORTGAGE as redemption for costs, lost taxes, attorney’s fees and city expenses, and that the City Attorney is authorized to sign all documents necessary to reverse the Wayne County tax foreclosure on 1583 College. Motion unanimously carried.

Thank you Thank you Don Diego! I was totally unaware of the previous action from 2003! Instruction was given to the city atty to correct this over a year ago. To date they are just now requesting the tax amounts even owed to the city. I think our city atty just happen to forget all about this property. Period. I do not believe its been in litigation all this time if at all. Think about it. If the h/o paid their taxes in their mortgage payment ( common ) then I do not see it taking all this many years to resolve and the h/o and the mtg company losing their interest in the property for back taxes. If the mtg was not paid the mtg company Abn Amro would have foreclosed on the mtg. Tricky part now is they CANNOT foreclose. It would be pointless because they cannot resell the property because the City is in Ownership. How can they get rid of our interest? Big mess and I am sure a big headache for the h/o all the way around. Abn Amro don't even know what to pay for tax amounts. As we seen tonight the figures have just been received per Mr. Zelenak. Our Assessor does a heck of a job. He came into our city after and inherited quite a work load. For the longest time we did not have an assessor and one woman working in the office all by herself. I am certain he was just asked for this information recently. If someone was sleeping on this deal I am pretty certain it was Mr. Zelenak. Get the amounts owed over to Abn Amro, forward the taxes on to the city and give the rightful owner back their home. |
